1. Acceptance of Terms

By accessing or using Podium Draft (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Podium Draft.

2. Eligibility & Minimum Age

• You must be at least 13 years of age to create an account
• Users between 13 and 17 must have parental or guardian consent
• By creating an account, you confirm that you meet these requirements
• Podium Draft reserves the right to terminate any account that does not meet these criteria
• We do not knowingly collect data from children under 13 — if we become aware of such an account, it will be deleted immediately
• A parent or guardian may request removal of a minor's account by emailing admin@podiumdraft.com

3. Account Registration

• You must provide a valid email address and accurate information when registering
• You are responsible for keeping your account credentials secure
• You are responsible for all activity that occurs under your account
• You may not create more than one account per person
• You may not create an account on behalf of another person without their explicit consent

4. The Game — Free to Play

Podium Draft is a free-to-play fantasy sports application. No entry fee, wager, or financial stake is required to participate. No real money is at risk in gameplay. Any prizes or rewards offered are at the sole discretion of Podium Draft and do not constitute gambling under applicable law.

The 2026 season is entirely free. Podium Draft reserves the right to introduce optional premium paid features in future seasons. Any paid features will be clearly communicated in advance.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service or another user's account
• Use automated tools, bots, or scripts to interact with the Service
• Upload or transmit any malicious code, spam, or harmful content
• Impersonate any person or entity
• Harass, abuse, or harm other users
• Attempt to manipulate scores, leaderboards, or game outcomes
• Scrape, copy, or republish content from the Service without permission

Violations may result in immediate account suspension or permanent termination without notice.

6. Athlete Data and Scores

Podium Draft uses publicly available athlete performance data from sanctioned competitive fitness events. Scores are calculated based on published event results. While we strive for accuracy, Podium Draft does not guarantee that scores are error-free or that results will be available immediately after events conclude.

7. Intellectual Property

All content, design, code, trademarks, and brand assets on Podium Draft (including the PODIUM/DRAFT wordmark, scoring systems, and game mechanics) are the property of Podium Draft and Brett Vlotman. You may not reproduce, distribute, or create derivative works without written permission.

Athlete names and images are used for editorial/reference purposes only. All athlete names and likenesses remain the property of the respective individuals.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Podium Draft and Brett Vlotman shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or service interruptions.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

9. Account Deletion

You may delete your account at any time from your account settings or by emailing admin@podiumdraft.com. Upon deletion, all personal data will be removed within 30 days in accordance with our Privacy Policy.

10. Termination by Podium Draft

We reserve the right to suspend or terminate any account at any time for breach of these Terms, fraudulent activity, or any other reason we deem appropriate. We will endeavour to notify you by email when possible.

11. Dispute Resolution

See our full Dispute Resolution Process. In summary: email admin@podiumdraft.com with the subject line "DISPUTE" and a clear description. We aim to respond within 5 business days. Podium Draft's decision on scoring and game rule interpretation is final.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved informally will be subject to the jurisdiction of the courts of South Africa.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the new Terms. We will notify registered users of material changes by email.
